Michigan's court structure flows from the Supreme Court at the top, through the Court of Appeals, down to the trial courts. The Macomb County Circuit Court is the trial court that hears the biggest cases brought in this county.

How a Case Moves Through Macomb's Courts

The case flow depends on the case type. A felony case begins in district court for arraignment, then a probable cause conference and a preliminary examination. If probable cause is found or waived, the district court binds the case over to the 16th Judicial Circuit Court for arraignment on information and the rest of the case. Most civil cases over $25,000 start in Circuit Court. Domestic relations cases (divorce, custody) start in Circuit Court. Misdemeanors and small civil cases stay in district court unless appealed.

Circuit Court Online Services

The court page links case lookup, payment options, forms, jury duty, bail bonds, court proceeding video requests, court newsletters, attorney contact updates, live proceedings, eFiling resources, MiFile, transcript requests, and the Clerk/Register of Deeds. eFiling is supported for Civil Cases, divorce-without-minor-children, and PPO case types under Macomb's Clerk page. Live court proceeding viewing and request-for-video workflows are linked from the same page. The Friend of the Court office serves the 16th Judicial Circuit Court for enforcement of support, alimony, and parenting-time orders.

The Circuit Court Bench

The 16th Judicial Circuit Court has multiple judges who handle the felony, family, civil, and business dockets. Judges are elected to six-year terms under Michigan law. The court's chief judge handles administration in addition to a regular caseload. Court divisions cover criminal, civil, and family law. Friend of the Court reports up through the family division. Specialty courts — Drug Court, DWI/Sobriety Treatment Court, Mental Health Court, Veterans' Treatment Court, and Swift and Sure Sanctions — each have an assigned judge who runs that docket alongside regular caseload.

Personal Protection Orders at Circuit Court

PPO cases are linked from the 16th Circuit Court forms and services area. PPOs include domestic relationship PPOs, nondomestic PPOs, nondomestic sexual assault PPOs, and minor PPOs. Public access to PPO files is more limited than ordinary civil access. Protected addresses, victim identifying details, and minor information may be sealed or redacted. The Clerk page links Macomb's PPO forms and the county's request-for-hearing form. Macomb's Clerk says PPO case types PP, PH, and PJ are e-file eligible — one of the categories where Michigan's eFiling system covers initial case filings.

Specialized Business Court Docket

Michigan business courts handle business and commercial disputes within Circuit Court. Macomb's Specialized Business Court Docket is run through the Specialty Court Services Department. Cases on the business docket include contract claims, shareholder disputes, trade secret issues, business torts, and statutory business actions where the case qualifies under MCL business court eligibility rules. Filing in the business docket happens at the regular Clerk's Court Section; the case is then assigned to the business docket judge for civil case management.

Friend of the Court

The Friend of the Court (FOC) serves the 16th Judicial Circuit Court for enforcement of child support, alimony, custody, and parenting-time orders. FOC docket activity does not appear in CourtView the same way as ordinary civil entries; FOC files contain financial and child-related details that are not visible like ordinary public records. Domestic relations cases (divorce, custody, support, parenting time) almost always include an FOC component. Public access to specific FOC details is more restricted than ordinary civil access because of the sensitive content.

Macomb County Prosecutor at Circuit Court

The Macomb County Prosecutor's Office handles state criminal prosecutions in the 16th Judicial Circuit Court. Prosecutor news pages list current press releases, victim service initiatives, and policy updates. Peter J. Lucido is named in recent county prosecutor news as Prosecutor. For criminal cases that move through Circuit Court after district court bindover, the Prosecutor's Office runs the state's side of trial preparation, plea negotiations, and sentencing recommendations.

Public Defender at Circuit Court

The Macomb County Office of Public Defender at 22 Market Street, Mount Clemens, 586-466-8311, represents indigent defendants in criminal cases. Indigency is determined by the court at the first appearance. The Public Defender's office provides experts, investigators, interpreters, and transcripts for indigent cases. Felony cases at Circuit Court frequently involve Public Defender representation after the case binds over from district court.

Appeals from the Macomb Circuit Court

Most appeals from the 16th Judicial Circuit Court go to the Michigan Court of Appeals. Some matters reach the Michigan Supreme Court by discretionary review. District court appeals are heard by the 16th Circuit Court itself, which means a person who lost in district court can appeal up to Circuit Court before going on to the Court of Appeals. A sealed or set-aside file keeps its restricted designation through the appeal under MCR 8.119.
